Terms of Use

These Terms of Use (“Terms”) govern your use of SocialQd (the “Service”), a product operated by Klvr Digital (“we”, “us”). Please read them carefully.

1. Acceptance of terms

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you are using SocialQd on behalf of an organization, you represent that you are authorized to bind that organization.

2. Eligibility

You must be at least 16 years old and able to form a binding contract to use the Service. You are responsible for complying with all laws that apply to your use of SocialQd and the content you publish.

3. Your account

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly of any unauthorized use. You must provide accurate information and keep it up to date.

4. Subscriptions, billing & refunds

  • SocialQd offers a limited Free plan and paid plans (Starter, Pro, Agency) billed monthly, quarterly or yearly. Plan features and limits are described on our pricing page.
  • Paid plans renew automatically at the end of each billing period unless cancelled beforehand. You can cancel at any time; access continues until the end of the paid period.
  • Prices are in U.S. dollars and exclusive of taxes unless stated otherwise. We may change pricing with notice; changes apply to subsequent billing periods.
  • Except where required by law, payments are non-refundable. Free-plan limits (such as the number of connected accounts and scheduled posts) are enforced and may change.

5. Acceptable use

You agree not to use SocialQd to:

  • Violate any law or the terms, policies or rate limits of any connected platform;
  • Publish spam, malware, deceptive, infringing, hateful or unlawful content;
  • Infringe others’ intellectual property or privacy rights;
  • Attempt to gain unauthorized access to, disrupt, or reverse-engineer the Service;
  • Resell or provide the Service to third parties except as expressly permitted (for example, via the Agency plan).

6. Your content

You retain all rights to the content you create or upload. You grant us a limited license to host, process and transmit that content solely to operate the Service and publish on your instruction. You are responsible for having the rights necessary to publish your content.

7. Third-party platforms & APIs

SocialQd integrates with third-party platforms using their official APIs. Your use of those platforms is governed by their own terms, and their APIs may change, limit or remove features at any time. We are not affiliated with or endorsed by these platforms, and we are not responsible for their availability or actions. Where a platform’s API does not permit a feature, that feature will be unavailable.

8. Affiliate program

If you participate in the SocialQd affiliate program, you also agree that: commissions are paid only on qualifying, paid referrals that remain in good standing; self-referrals, fraudulent, incentivized or misleading promotion are prohibited; commissions may be reversed for refunds, chargebacks or cancellations; payouts are subject to a minimum threshold and a clearing/hold period; and we may adjust rates, withhold payment for suspected abuse, or terminate participation at our discretion. You are responsible for any taxes on amounts you earn.

9. Intellectual property

The Service, including its software, design, and the SocialQd name and logo, is owned by Klvr Digital and protected by law. These Terms do not grant you any right to our trademarks or branding except as needed to use the Service.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that posts will always be delivered, given third-party platform dependencies.

11. Limitation of liability

To the maximum extent permitted by law, Klvr Digital will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

12. Indemnification

You agree to indemnify and hold harmless Klvr Digital from claims arising out of your content, your use of the Service, or your violation of these Terms or any third-party rights.

13. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Provisions that by their nature should survive termination will survive.

14. Governing law & changes

These Terms are governed by the laws of the United States and the state in which Klvr Digital operates, without regard to conflict-of-laws rules. We may update these Terms; material changes will be reflected by the “Last updated” date and, where appropriate, in-app notice. Continued use after changes means you accept the updated Terms.
